Either way not to worry, if you think it's #38 then that didn't carry a 107 boiler until 1961 which is much too late for this photo and by that time had a double chimney. However, #38 did carry a 94HP (round dome) from 1955 - 1958 but a 94A (streamlined dome) before and after. It's not after 1959 as a double chimney was fitted then and given that one of the coaches in the second shot is maroon I'd be looking at the 55 - 58 period.
Round domes are further forward than streamlined and slightly taller and it does on the face of it look like it's centred over the middle boiler ring at the front of the taper rather than further back between the two tapered rings.
60038 was based at Gateshead 53-56, Darlington 56-57 and back to Gateshead 56-57 then to Holbeck 57-60.
Given that 'The Queen of Scots' changed engines at Leeds; Copley Hill and Neville Hill are the two sheds down to supply engines on this train. It could be that #38 from Holbeck is standing in but exceedingly rare if at all to be honest, the evidence does not stack up I'm afraid.
However 60053 was based at Copley Hill from 5/54 to 9/57 and Coupe News has her listed only twice during that stay on the down The Queen of Scots on dates 5th May 55 and 4th Apr 56, it doesn't list any other dates and whilst not exhaustive is pretty comprehensive, example :- http://www.semgonline.com/coach/coupe/pull_ciwl-news026.pdf

60038 is also listed but only on trains North of Leeds, none south, which fits her shed allocations.
The Queen of Scots left London at 11:50 AM so how long does it take to get to Retford in steam days, 90-120mins? which puts the time around 13:20 - 13:50 which fits the sun angle a bit better.
